ˇ@ˇ@The Ministry of Foreign Trade and Economic Cooperation (MOFTEC) announced an anti-dumping investigation into caprolactam imported from Japan, Belgium, Germany, the Netherlands and Russia (investigated product) in its notice on Dec. 7, 2001. The investigated product is listed under No. 29337100 in the import tariffs of the General Administration of Chinese Customs.

ˇ@ˇ@MOFTEC and State Economic and Trade Commission have made the investigation separately on dumping and the range of dumping, damage and the degree of damage to Chinaˇ¦s industries. According to the investigation, MOFTEC issued tentative judgment on Jan. 7 2003, confirming that dumping of the investigated product had taken place and caused substantial damage to Chinaˇ¦s industries.

ˇ@ˇ@After the tentative judgment was issued, investigatory apparatus continued its probe into dumping, the range of dumping, damage and the degree of the damage of the investigated product and made final judgment as follows.

ˇ@ˇ@Approved by First Conference of Tenth National Peopleˇ¦s Congress, the Ministry of Commerce has carried out the anti-dumping investigation. The Ministry of Commerce affirmed that dumping had taken place and there was a direct causal relationship between the dumping and the damage.

ˇ@ˇ@According to Anti-dumping Regulations of the Peopleˇ¦s Republic of China, Customs Tariff Commission of the State Council will collect anti-dumping duty of caprolactam imported from above countries as of June 6, 2003.

ˇ@ˇ@The rate of anti-dumping duty collected from related companies is as follows:

Japanese Companies:
1. Sumitomo Chemical Company, Ltd: 5%
2. UBE Industries, Ltd: 8%
3. Mitsubishi Chemical Corporation: 10%
4. Toray Industries, Inc.: 5%
5. All others: 18%

Belgian Companies:
1. BASF ANTWERPEN N.V.: 6%
2. All others: 16%

German Companies
1. DOMO Caproleuna GmbH: 22%
2. All others: 28%

Companies of Holland
1. DSM Fiber Intermediates B.V.: 6%
2. All others: 18%

Russian Companies
1. Kuibishevazot Joint Stock Company: 7%
2. Kemerovo Joint Stock Company ˇ§AZOTˇ¨: 9%
3. All others: 16%
